- Nguyên tắc đặt tên doanh nghiệp:
- Tên doanh nghiệp là do doanh nghiệp tự chủ (tự đặt) nhưng phải đảm bảo không trùng hoặc không gây nhầm lẫn với tên doanh nghiệp khác
(Căn cứ khoản 1 điều 38 Luật Doanh Nghiệp 2020)
TÊN CÔNG TY = LOẠI HÌNH CÔNG TY + TÊN RIÊNG
Như vậy, có thể thấy, một tên công ty đúng và hoàn chỉnh, sẽ bao gồm 2 thành tố: (i) Loại hình công ty và (ii) Tên riêng của công ty.

- Về loại hình công ty:có những loại hình công ty và cách viết như sau:
- Công ty trách nhiệm hữu hạn một thành viên và công ty trách nhiệm hữu hạn 2 thành viên trở lên, sẽ được viết như sau: “Công ty trách nhiệm hữu hạn” hoặc “Công ty TNHH”
- Công ty cổ phần, sẽ được viết như sau: “Công ty Cổ Phần” hoặc”Công ty CP”
- Doanh nghiệp tư nhân, sẽ được viết như sau: “Doanh nghiệp tư nhân” hoặc “DNTN”
- Công ty hợp danh, sẽ được viết như sau: “Công ty hợp danh” hoặc “Công ty HD”
- Về tên riêng:thì doanh nghiệp có thể đặt theo ý muốn của mình nhưng không được trùng hoặc gây nhầm lẫn với tên doanh nghiệp khác. Tên riêng được viết bằng các chữ cái trong bảng chữ cái tiếng Việt, các chữ F, J, Z, W, chữ số và ký hiệu (Theo điểm b, khoản 1, điều 39 Luật Doanh nghiệp)
Tên tiếng nước ngoài: (tên tiếng Anh đang được sử dụng đa số) khi dịch sang tiếng nước ngoài, có thể giữ nguyên hoặc dịch theo nghĩa tương ứng
Tên viết tắt: của doanh nghiệp được viết tắt từ tên tiếng Việt hoặc tên viết bằng tiếng nước ngoài.
- Cách tra cứu tên doanh nghiệp tránh bị trùng:
Bước 1: Truy cập vào Trang chủ của Cổng Thông tin quốc gia về đăng ký doanh nghiệp tại địa chỉ: https://dangkykinhdoanh.gov.vn
Bước 2: Nhập phần tên riêng của công ty vào ô Tìm doanh nghiệp để tìm kiếm
Bước 3: Hệ thống thông tin doanh nghiệp quốc gia sẽ hiển thị tất cả các tên doanh nghiệp đã đăng ký giống hoặc gần giống với tên công ty mà bạn định đặt
Với những tên phổ biến, có nhiều doanh nghiệp đã sử dụng, khi tra cứu tên doanh nghiệp xem có bị trùng không, bạn nên kiểm tra ít nhất 10 trang kết quả tìm kiếm, bằng cách click vào các trang ở phía cuối của website.
Bước 4: Nếu không thấy xuất hiện tên công ty nào thì tên dự kiến đặt không bị trùng. Tuy nhiên, đa phần đều có tên giống hoặc gần giống, do vậy, cần biết cách đặt tên doanh nghiệp để tránh trùng tên hoặc gây nhầm lẫn.
