VISA FOR FOREIGN WORKERS IN VIETNAM

  1. DEFINITION OF VISA IN VIETNAMESE LAW:
  • Pursuant to Clause 11 Article 3 of Law on Entry, exit, transit and residence of foreigners in Vietnam 2014:

“Visa means a document issued by a competent authority of Vietnam to a foreigner to grant entry into Vietnam.”

  • Worker visa symbols are:
  1. LD1 – Issued to foreigners working in Vietnam with confirmation that they are not eligible for work permits, unless otherwise provided for in an international treaty to which Vietnam is a signatory.

16a. LD2 – Issued to foreigners working in Vietnam who are required to have a work permit.

  • Worker visa is usually valid for a maximum of 2 years. In case the work permit is not valid for 2 years, the duration of the visa for foreigners will be equal to the duration of the work permit.
  1. THE CONDITIONS TO APPLY FOR WORKER VISA:
  • According to Article 10 of Law on entry, exit, transit and residence of foreigners in Vietnam 2014:
  • Have a passport or a valid international travel document.
  • There are agencies, organizations and individuals in Vietnam to invite or guarantee.
  • Not falling into the cases of not allowing entry as prescribed in Article 21 of Law on Immigration of Vietnam No. 47/2014/QH13.
  • If the foreign worker is guaranteed or invited by an agency or organization to work with an enterprise in Vietnam:
  • Agencies or organizations that invite or guarantee foreigners to work are enterprises established under Vietnamese law;
  • Agencies and organizations that invite or guarantee foreigners must conform to their functions, tasks, and powers prescribed by law or granted operation licenses.a
  1. PROCEDURES TO APPLY FOR A WORKER VISA IN VIETNAM

a) In case of the foreigner of being not in the Vietnamese territory:

Step 1: Prepare documents to apply for a visa to enter Vietnam.

Step 2: Submit your application at the Immigration Department and receive an appointment letter for the results. If You need to receive authentication at the diplomatic department of Vietnam in the host country, You must pay an extra fee.

Address of Immigration Department:

  • In Hanoi: 44 – 46 Tran Phu, Ba Dinh District, Hanoi
  • In HCMC: 333 – 335 – 337 Nguyen Trai, District 1, City. Ho Chi Minh

After about 5 working days from the date of submitting the proper documents, the Immigration Department will return the result of the entry acceptance. Accordingly, this official letter will specifically record the time when the foreigner enters Vietnam and the place to receive the work visa.

Step 4: Notify the result to foreigners

Once the result of the entry acceptance is available, the guaranteeing enterprise will send you an email to notify and an entry letter to carry out procedures to receive visa at Vietnam’s diplomatic department in your country or receive visa at Vietnam’s international airports.

Step 5: Fill in NA1 information and pay the fee

Filling out the NA1 form and paste a portrait photo in size of 4*6cm in NA1as well as phot of the passport and the entry document. Finally, pay the visa fee and get the visa to enter Vietnam.

b) In case a foreigner is staying in Vietnam:

Step 1: Prepare all documents to apply for a work visa in Vietnam as follows:

  • Operation licenses of organizations and enterprises include: business registration papers, investment licenses, operation licenses of representative offices and branches;
  • Certificate of use of seal sample or notice of use of enterprise’s seal;
  • A document introducing the seal according to form NA16, signed by an authorized person of the organization. You submit this declaration if you are applying for the first time at the Immigration Department;
  • Application form for Vietnam work visa, form NA5 and temporary residence extension paper;
  • The original passport of the visa applicant is still valid as prescribed;
  • Work permit or work permit exemption for foreigners who are exempt from work permits;
  • Temporary residence book or certificate of temporary residence of foreigners.

Note: a prerequisite for Forei gn Workers to work in Vietnam or get a visa in Vietnam is that they must have a Work Permit or are exempt from work permits.

Step 2: Foreign individuals can directly go to the Immigration Department to submit documents or authorize an enterprise or a service-providing organization to do in behalf of them.

Step 3: Recieve Vietnam work visa results for foreigners.

Within 5-7 working days from the date of submission of proper documents, the competent authority in Vietnam will send the guarantor a document replying the results.
